These Terms of Service ("Terms") govern access to and use of the Ardent Gold website, operated by Ardent Gold LLC ("Ardent Gold," "we," "us," or "our"). Please read them carefully before using the site.
1.Acceptance of Terms
By accessing, browsing, or using ardentgold.co (the "site"), you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you must not access or use the site. These Terms apply to all visitors and users of the site. If you access or use the site on behalf of a company or other entity, you represent and warrant that you have the authority to bind that entity to these Terms.
2.Eligibility
The site is intended for users who are at least 18 years of age and legally capable of entering into binding agreements. By using the site, you represent and warrant that you meet these requirements. The site and the services described on it are directed to users located in the United States, and we make no representation that the content is appropriate or available for use in other locations.
3.About This Website and Our Role
The site is informational in nature and describes services related to coordinating the purchase and insured depository storage of IRS-approved precious metals for self-directed retirement accounts. In particular:
- Use of the site alone does not create any client relationship, account, or transaction between you and Ardent Gold.
- Ardent Gold facilitates and coordinates these services but does not take possession of client funds or client metals at any point.
- Any services are provided subject to separate written agreements, as described in these Terms.
4.Not Financial, Tax, Legal, or Investment Advice
All content on the site is provided for general informational and educational purposes only. It is not investment, financial, tax, retirement, or legal advice, and it must not be relied upon as such. Ardent Gold is not a registered investment adviser, broker-dealer, law firm, or accounting firm, and does not provide individualized advice of any kind. You are solely responsible for your own decisions, and you should consult your own qualified, licensed professionals before acting on any information found on the site. Nothing on the site creates a fiduciary, advisory, or professional relationship between you and Ardent Gold.
5.Precious Metals and Investment Risk
You acknowledge and accept the following:
- Precious metals carry risk, including price volatility and the potential loss of value.
- Precious metals markets can fluctuate significantly over short and long periods.
- Past performance does not guarantee future results.
- Precious metals do not produce income such as dividends or interest.
- Precious metals may not be suitable for every investor or every portfolio.
- Nothing on the site is a promise or guarantee of any return, outcome, performance, or appreciation.
6.Separate Agreements Govern Any Transaction
Any actual precious metals purchase, self-directed IRA account, custody, storage, or related service is governed by separate written agreements between you and the relevant parties, including the IRA custodian and the depository. These website Terms do not govern those transactions. In the event of a conflict between these Terms and a separate transaction agreement, the separate agreement controls with respect to its subject matter. You should review those agreements carefully before entering into them.
7.Third-Party Services, Custodians, and Depository
The site references, and the services involve, independent third parties, including self-directed IRA custodians and the depository, IDS (International Depository Services). Ardent Gold does not own or control these third parties and is not responsible or liable for their acts, omissions, services, fees, performance, solvency, or content. References to third parties are descriptive only and do not constitute endorsements or guarantees. Your relationship with any custodian or depository is governed by that party's own terms and agreements.
8.Third-Party Links
The site may contain links to third-party websites. Ardent Gold does not control and is not responsible for the content, policies, or practices of any third-party website. Accessing any linked website is done at your own risk.
9.Intellectual Property
All content on the site, including text, graphics, logos, branding, design, and layout, is the property of Ardent Gold LLC or its licensors and is protected by applicable intellectual property laws. You may view and use the site for personal, non-commercial purposes only. Reproduction, distribution, modification, or commercial use of any content without prior written permission is prohibited. The Ardent Gold name and marks may not be used without our permission.
10.Acceptable Use

To the fullest extent permitted by law, Ardent Gold LLC and its members, officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of, or inability to use, the site, even if advised of the possibility of such damages. To the extent that liability cannot be excluded, it is limited to the maximum extent permitted by law.
14.Indemnification
You agree to indemnify, defend, and hold harmless Ardent Gold LLC and its members, officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your misuse of the site, your violation of these Terms, or your violation of any law or third-party right.
15.Survival
Any provisions that by their nature should survive termination or discontinued use of the site will survive, including the sections titled Not Financial, Tax, Legal, or Investment Advice; Precious Metals and Investment Risk; Intellectual Property; Disclaimer of Warranties; Limitation of Liability; Indemnification; and Governing Law and Dispute Resolution.
16.No Waiver
The failure of Ardent Gold to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision. No waiver of any term will be deemed a further or continuing waiver of that term or any other term. A waiver is effective only if made in writing by an authorized representative of Ardent Gold.
17.Assignment
You may not assign or transfer these Terms, or any rights or obligations under them, without Ardent Gold's prior written consent, and any attempted assignment in violation of this section is void. Ardent Gold may freely assign or transfer these Terms, including in connection with a merger, acquisition, or sale of assets.
18.Electronic Communications
By using the site or contacting Ardent Gold electronically, you consent to receive communications from Ardent Gold electronically. You agree that any electronic communications and records satisfy any legal requirement that such communications be in writing.
19.Force Majeure
Ardent Gold is not liable for any failure or delay in performance resulting from causes beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, governmental action, power or internet failures, or third-party service disruptions.
20.Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.
21.Entire Agreement
These Terms, together with the Privacy Policy and any separate agreements referenced in them, constitute the entire agreement between you and Ardent Gold regarding your use of the site, and supersede any prior understandings or agreements on that subject.
22.Headings
Section headings in these Terms are for convenience only and do not affect the interpretation of these Terms.
23.Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law principles. You agree that any disputes arising out of or relating to these Terms or the site will be subject to the jurisdiction of the appropriate state or federal courts located in Utah, unless otherwise required by law.
24.Changes to These Terms
Ardent Gold may modify these Terms at any time. The updated version becomes effective when posted with a revised "Last updated" date. Your continued use of the site after changes are posted constitutes your acceptance of the revised Terms.
